Privacy Notice
Last updated: 2026-10-21
This notice is subject to final legal review. Questions: privacidad@valai.mx.
1. Data controller
ValAI (“the Platform”), operated by Tadewan Pascua and ValerIA.valAI, based in Mérida, Yucatán, Mexico, is responsible for processing your personal data. Contact: privacidad@valai.mx.
2. Data we collect
Identification and contact data (name, email, phone/WhatsApp), account data (role, agency, encrypted credentials), and the property/inquiry data you submit. Where the law requires (real-estate intermediation/AML), we may request additional identification (KYC). We also process: the contact data of clients an agent registers in their account (name, email, phone, for which kind of deal) and any proof of that relationship the agent chooses to attach; the date of your first contact with an agent through Valeria; and the business contact data of developers and master brokers whose inventory agents offer, with their answer on whether they authorize showing it; and any proof of a source's written authorization an agent chooses to attach (stored encrypted, seen only by the Valeria team).
3. Purposes
Primary: create/manage your account; connect owners, realtors and buyers; track properties, representations and leads; respect the relationship between a buyer and their agent (dated registration of each agent's clients, asking which agent you work with, resolving disagreements between agents); comply with legal duties (INSEJUPY, LFPIORPI/AML, tax). Secondary: service improvement and platform communications; you may opt out without affecting your account.
4. Transfers
We do not sell your data. We may share it with: the realtor/agency you choose to connect with (when several agents offer a home, your details reach only the one you choose; if you already work with an agent registered on Valeria, your message goes to them and the other agent only learns you already have one); service providers (hosting, messaging, payments) under confidentiality; an artificial-intelligence provider (Google Gemini) that answers the questions you type into «Ask Valeria» and the plain-words search: we remove phone numbers and emails before sending them, and on its free tier Google may use them to improve its products; and authorities where legally required (e.g. UIF/SAT, the notario at closing).
Voice messages (voz01): what you record in Valeria for someone else is kept on our private disk, never public (heard by the person who gets it, you and the administrator), and is written out and translated by the AI the sender or the recipient connected with their own account in «My AI»; it is kept like messages. If you talk to «Ask Valeria» in a browser without its own dictation, the audio goes to the AI provider only to write it out and is not kept.
4 bis. If an agent registers you as their client
An agent may register in their account the people they already work with. The agent is responsible for having your data and your permission; Valeria processes it on the agent's behalf only to respect that relationship. Valeria may send you a single message to confirm you work with that agent (only when the agent asks); if you answer no, the registration stops counting. Your data is not shared with other agents. If agents disagree, Valeria reviews the proof they provide (e.g. message screenshots) only to resolve it and keeps it as long as needed. You can ask for the registration to be deleted at privacidad@valai.mx.
4 ter. Emails from your agent through Valeria
If your agent turns it on, Valeria sends you on your agent's behalf, at most once a month, homes that match what you are looking for, and the emails your agent prepares for their clients. They carry your agent's name, your replies go to them, and every one has a one-tap unsubscribe link; unsubscribing stops every email from that agent through Valeria. They are never sent to people who only asked about one home on Valeria.
5. ARCO rights
You may Access, Rectify, Cancel or Object to the processing of your data, and revoke consent, by writing to privacidad@valai.mx. Note: certain identification/transaction records are retained for the period AML law requires, even after a cancellation request.
6. Cookies
We use strictly necessary cookies for the session and site function. No third-party ad tracking.
To know how many people visit Valeria and from where, we count visits without cookies: we keep the page, the time, where you came from (for example, Google or an email) and your approximate city or state. Your IP address is used only at that moment to get that location and is not stored. If you arrive through the personal link of an email we sent you (for example, an invitation), that visit is tied to your invitation so we know whether it interested you.
7. Changes
We may update this notice; the current version is posted here with its date.
8. Consent
By creating an account and checking the corresponding box, you give express consent to process your data under this notice.
